Barriers to Public Interest Litigation
Certain factors make it difficult for public interest issues to have their day in court. PILA considers the main barriers to public interest litigation to be: costs; standing rules; mootness; lack of class actions; the non-justiciability of socio-economic rights.
This section contains information on these barriers in this jurisdiction and England and Wales, Northern Ireland, Australia, Canada and South Africa. PILA will be working with practitioners to identify practical ways by which to overcome or circumvent these barriers.
