Minister for Justice takes action post-Zambrano; ICI welcomes judgment; DIT seminar on Zambrano 14 April 2011

As reported in a previous Bulletin, the European Court of Justice has ruled that the non-EU parents of an EU citizen child have a right to live and work in that EU state, ensuring that the child can benefit from their rights as an EU citizen.

Minister for Justice statement

The Minister for Justice, Equality and Defence, Mr Alan Shatter has stated that he has instructed his officials to carry out an urgent examination of all cases before the courts (approximately 120 at present) involving Irish citizen children, to which the Zambrano judgment may be relevant. He stated "we should not tie up the courts unnecessarily or ask eligible families to wait longer than necessary".

Dublin Institute of Technology seminar

DIT will host a seminar: "Reflections on the Zambrano decision of the Court of Justice- its impact on Constitutional Law, European Union Law and Immigration Law in Ireland" on 14 April 2011 6.00pm-7.30pm.

Discussants: Dr. Stephen Carruthers; Dr. Elaine Fahey; Dr. Fergus Ryan.

The seminar will consider several themes: EU Citizenship and national sovereignty, domestic nationality and citizenship law, the Irish Born Child scheme, Irish Supreme Court decisions on Immigration, the Family and the Constitution, EU Citizenship in the Irish courts and recent decisions of the Court of Justice on Citizenship in EU law.
