Using the EU Charter of Fundamental Rights Workshop, Trinity College Dublin – 12 January 2017

While the EU Charter has been legally-binding since 2009, its rights can only be enforced in situations that fall within the scope of EU law. There is a growing body of case-law from the Court of Justice of the EU, as well as national courts, examining which situations fall within the scope of the EU Law and where the Charter may be applied. Nevertheless, the complexity of the case-law means that this remains one of the most ambiguous points of law, even though it is critical for understanding when individuals may rely upon the Charter in legal proceedings.  

A EU-funded project called “Don’t knock on the wrong door: CharterClick” has designed online resources that aim to provide a practical guide to assist individuals, advocacy groups and lawyers in making an initial assessment of whether the Charter could be applicable to their situation. The aim of this workshop is to provide an overview of case-law from the Court of Justice and Irish courts on when the Charter can be applied, as well as introducing the online resources from this project.
